Defense of Marriage Act (DOMA) (Pub.L. 104-199, 110 Stat. 2419, diberlakukan September 21, 1996, 1 U.S.C. § 7 dan 28 U.S.C. § 1738C) adalah hukum federal Amerika Serikat yang membatasi manfaat pernikahan hanya untuk pernikahan lawan jenis dan hanya mengakui pernikahan lawan jenis dalam tingkatan federal. Hukum ini disetujui oleh Kongres dengan suara mayoritas dan ditandatangani oleh Presiden Bill Clinton menjadi hukum pada tanggal 21 September 1996. Bagian 3 DOMA tidak mengakui pernikahan sesama jenis dalam berbagai kepentingan federal, termasuk manfaat asuransi untuk karyawan pemerintah, keuntungan jaminan sosial, imigrasi, dan pengajuan laporan pajak gabungan.
Clinton dan anggota dewan lainnya mengubah pandangan mereka dan mendukung pencabutan hukum ini. Pemerintahan Barack Obama mengumumkan pada tahun 2011 bahwa mereka menganggap bagian 3 DOMA tidak konstitusional dan, walaupun akan tetap menerapkan hukum ini, tidak akan mempertahankannya di pengadilan. Sebagai tanggapan atas hal ini, kepemimpinan Partai Republik di Dewan Perwakilan Rakyat memerintahkan kepada House General Counsel agar mempertahankan hukum ini untuk menggantikan Departemen Kehakiman.
Bagian 3 DOMA dianggap tidak konstitusional oleh delapan pengadilan federal, termasuk Pengadilan Banding Pertama dan Kedua untuk isu seperti kebangkrutan, keuntungan karyawan, pajak pewarisan, dan imigrasi. Mahkamah Agung Amerika Serikat menerima banding dalam salah satu kasus tersebut, yaitu United States v. Windsor, dan mendengarkan argumen lisan pada 27 Maret 2013.
