The social benefit under § 28 SGB II is an integral part of the German welfare system, created as a special performance to substitute or complement the social assistance (HLU) stipulated in the Twelfth Book of the Social Code (SGB XII). The benefit specifically targets vulnerable individuals meeting the following criteria:
They are not of working age (such as children, or they cannot go to work for one or another reason).
They are living in a "community of need" (Bedarfsgemeinschaft) according to § 7 para. 3 SGB II, frequently with gainfully employed and insured persons taking benefit under SGB II (such as relatives).
The social benefit is not entitled to basic protection according to § 41 SGB XII.
Main Provisions:
Minor children of entitled beneficiaries who fall under non-employment reasons, like students, are eligible for this benefit.
The goal is to ensure all the members of a "unit" or household receive adequate support, even if they do not qualify individually for other forms of assistance. References
